TERMS OF SERVICE

Welcome to Holy Cannoli. By placing an order or using our website, you agree to the following Terms of Service. Please read them carefully before making a purchase. These terms apply to all customers regardless of location.
1. ACCEPTANCE OF TERMS
By accessing or purchasing from Holy Cannoli, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or place an order.
2. PRODUCT INFORMATION
Holy Cannoli imports and sells authentic Italian goods including, but not limited to, food products, pantry items, confectionery, and specialty ingredients. We take great care to source genuine products directly from Italy.
Product descriptions, ingredients, and packaging are provided for informational purposes. Actual product packaging may vary from images shown on our website. It is the customer's responsibility to read all product labels upon receipt.
3. ALLERGEN DISCLAIMER & CUSTOMER RESPONSIBILITY
3.1 Customer Responsibility for Allergens
IMPORTANT: Holy Cannoli sells food products that may contain or come into contact with a wide range of allergens. By placing an order, you acknowledge and agree that:
- All allergen-related risks are solely the responsibility of the customer.
- It is the customer's responsibility to review all ingredient lists and allergen information on product packaging prior to consuming any item.
- Holy Cannoli is not liable for any allergic reactions, adverse health effects, or medical conditions arising from the consumption of any products purchased through our store.
- Customers with known food allergies, intolerances, or sensitivities should exercise extreme caution and consult a medical professional before purchasing or consuming any of our products.
3.2 Common Allergens
Our products may contain, or be manufactured in facilities that also process, the following allergens:
- Gluten and wheat
- Milk and dairy products
- Eggs
- Tree nuts (including almonds, hazelnuts, pistachios, and walnuts)
- Peanuts
- Soy
- Sesame
- Sulphites and sulphur dioxide
- Fish and shellfish
This list is not exhaustive. Holy Cannoli makes no guarantee that any product is free from allergens. Ingredient formulations may also change without notice — always read the product label upon receipt of your order.
4. PACKAGE INSPECTION UPON ARRIVAL
4.1 Duty to Inspect
Customers are required to inspect all packages and their contents upon delivery. By accepting delivery of an order, you agree to the following:
- You will inspect all packages at the time of delivery for any signs of damage, tampering, or spoilage.
- You will check all product labels, ingredient lists, and allergen information immediately upon receipt before consuming any product.
- You will verify that the contents of the package match your order.
- You will inspect the condition of all food items including packaging integrity, seal condition, and any visible signs of deterioration.
4.2 Reporting Damage or Discrepancies
Any damage, missing items, or discrepancies must be reported to Holy Cannoli within 48 hours of delivery by contacting us at our designated support email. Claims made after this period may not be accepted. Where possible, please retain all original packaging and take photographs of any damage before contacting us.
4.3 Refrigerated and Perishable Items
Some products may require refrigeration or specific storage conditions. It is the customer's responsibility to refrigerate or store products appropriately immediately upon receipt. Holy Cannoli is not responsible for spoilage caused by improper handling after delivery.
5. ORDERS & PAYMENT
All orders are subject to availability and confirmation. Holy Cannoli reserves the right to cancel or refuse any order at our discretion. Prices are listed in the applicable currency and are subject to change without notice. Payment must be completed in full before an order is processed and dispatched.
6. SHIPPING & DELIVERY
Holy Cannoli endeavours to dispatch all orders in a timely manner. Delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs, or circumstances beyond our control. Risk of loss and title for products passes to you upon delivery to the carrier.
7. RETURNS & REFUNDS
Due to the perishable nature of food products, Holy Cannoli does not accept returns of food items unless the product is damaged, defective, or incorrect. Non-food items may be returned in their original, unopened condition within 14 days of receipt. Please contact us before sending any return.
Refunds, where approved, will be processed to the original payment method within 5–10 business days.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Holy Cannoli shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or the purchase and consumption of our products. This includes, without limitation, any allergic reactions, health complications, or losses arising from failure to inspect products upon delivery.
Our total liability in any matter arising from your purchase shall not exceed the total amount paid for the relevant order.
9. GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the applicable jurisdiction in which Holy Cannoli operates. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
10. CHANGES TO THESE TERMS
Holy Cannoli reserves the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or placement of an order after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
